JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Hawai Adda P.S. Case No. 52 of 2016 registered for the offence punishable under sections 406/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case with ulterior motive. Earlier order was made for five Air Conditioners, but later on order of one Air Conditioner was cancelled, and as such, finance was made for only four Air Conditioners. Petitioner had no role in the alleged incidence. Petitioner, later on, resigned from the services of the Company in question vide Annexure-4. Petitioner, on his resignation, was granted Experience Certificate vide Annexure-5. If there would have been anything against this petitioner, the Company would not

Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ratneshwar Kumar Singh, Sub Judge XII-cum- Additional Chief Judicial Magistrate, Patna in connection with Hawai Adda P.S. Case No. 52 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
