Mr. Navin Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 22-07-2026 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend arrest in connection with Kochas P.S. Case No. 54 of 2025 lodged on 24.02.2025, for the offence punishable under Sections 190, 191(2), 191(3), 223, 132 & 352 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against 18 named accused persons (all the present petitioners). The FIR has been lodged by the Circle Officer alleging that when the government officials went to implement the order passed in B.L.T. Case No. 1059 of 2024 and went on to the plot nos. 128 and 79, Mauja- Anhari to acquire the land, then many of the persons including the petitioners allegedly were present on the plot having stick, spear, sickle, morsel and they assaulted the government officials despite knowing the fact that the order has been passed by the Bihar Land Tribunal, Patna is not in the favour of the petitioners.
4. Learned counsel for the petitioners submits that the
3/4 petitioners are innocent and have committed no offence. He submits that the land in dispute was 62 acres which has been accepted in the FIR itself. He submits that against the order passed in B.L.T. Case No. 1059 of 2024, the petitioners have challenged the same before the Hon'ble Court. He submits that the petitioners have preferred appeal against the said order passed by the Bihar Land Tribunal. He submits that this specific pleading has been made in para 8 of the present bail application. He further submits that the petitioners have clean antecedent and they are ready to fulfill all the conditions whatsoever shall be imposed upon them.
5. Learned APP for the State opposes the prayer for bail of the petitioners.

After hearing the parties, it transpires to this Court that there is specific plea made by the counsel for the petitioners in para 11 of the present bail application that the petitioners were not made party before the Bihar Land Tribunal and order has been passed which they have challenged before the Hon'ble Court.
7. As such, in the present facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the Trial Court within a
4/4 period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of SubJudge-VII-cum-Additional Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Kochas P.S. Case No. 54 of 2025, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
