ANJANA MISHRA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the Bihar State Food Corporation and the learned counsel for the State.

The present application for modification has been occasioned seeking extension of further time for surrendering before the court below as mentioned in the order dated 9.11.2015 passed in Cr. Misc. No.14234 of 2015.

Learned counsel for the petitioner submits that the petitioner has undergone an operation at Delhi and, therefore, the direction of this Court could not be complied with. He accordingly seeks extension of a period of four weeks from today for the time in which period, it is submitted that the petitioner shall surrender. Considering the genuine grievance of the petitioner, the

Patna High Court Cr.Misc. No.55723 of 2015 (2) dt.09-12-2015 2/2 time fixed for surrender in the order dated 9.11.2015 passed in Cr.Misc. No.14234 of 2015 is extended and shall run from today. Further, as submitted by the learned counsel for the petitioner, the satisfaction of the Court mentioned in the said order dated 9.11.2015 is also modified and shall now be read as "to the satisfaction of Sub-Divisional Judicial Magistrate, Purnea" in place of "Chief Judicial Magistrate, Purnea," in connection with Kasba P.S. Case No.11 of 2015, as the case has now been transferred thereat.
