The instant application is renewed by the petitioner for regular bail which has been filed in connection with Fatehpur P.S. Case No. 153 of 2021 instituted for the offence u/s 363, 366(A)/34 of the Indian Penal Code.

Earlier the application for anticipatory bail of the petitioner was rejected by order dated 30.11.2022 passed in Cr. Misc. No. 30173 of 2022. Again the application for regular bail was rejected by order dated 19.04.2024, passed in Cr.Misc. No. 16170 of 2024 with

Patna High Court CR. MISC. No.48929 of 2024(2) dt.05-07-2024 2/3 an observation to learned trial court to expedite the trial and conclude the same as soon as possible.

As per allegation in the F.I.R., the petitioner is alleged to have abducted the minor daughter of the informant on the pretext of solemnization of marriage. Learned counsel for the petitioner submits that victim has not supported the prosecution case during trial in her deposition (annexed as Annexure P/6 to this bail application). She has deposed that no such occurrence has ever took place with her as alleged against the petitioner. She has flatly denied the allegation against him. Moreover, petitioner is languishing in judicial custody since17.01.2024. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail.

Case No. 153 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge POCSO Court-cum-Additional District & Sessions Judge VI, Gaya.
