2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Rajeev Nagar P.S. Case No. 235 of 2026, lodged on 18/04/2026, under Section 303(2) of the Bhartiya Nyaya Sanhita, 2023.
3. As per the prosecution, allegation of theft of Auto has been alleged in the FIR against unknown.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that FIR has been lodged against unknown accused

Counsel submits that the name of the petitioner has figured in this case by virtue of confessional statement of one Badal Kumar, who alleged to have involved in the crime. Counsel submits that the criminal antecedent of the petitioner is not clean, there is one case pending against the petitioner in which he is on bail. Counsel submits that the recovery of the said vehicle has been made from the road in which the house of petitioner is there and only on suspicion the police has named this petitioner and in the order-sheet it has come that the vehicle has been recovered near the house of the petitioner. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that the petitioner is not named in the FIR but his name has come in this case by virtue of confessional statement, due to the reason that the recovery has been made in the locality where the petitioner resides.
6. It transpires to this Court that due to the action on the part of the police, the petitioner has filed a complaint case before the said Munshi of the Rajeev Nagar Police Station.
7. As such, in the present facts and circumstances of this case, let the above named petitioner be released on
Patna High Court CR. MISC. No.48549 of 2026(2) dt.22-07-2026 3/3 anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Rajeev Nagar P.S. Case No. 235 of 2026 subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
