JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2018 Heard learned counsel for the petitioner.

Petitioner apprehends her arrest in connection with Thawe P.S.Case No. 57 of 2018 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. Allegation against the petitioner, who happens to be sister-in-law (Jethani) of the deceased, is of causing dowry death. Submission of learned counsel for the petitioner is that FIR does not disclose the name of the petitioner and as a matter of fact she committed suicide.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that paragraph 5 of the case diary shows that there was illicit relationship between the petitioner and husband of deceased and

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of her arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S.Case No. 57 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
