JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Araria P.S. Case No. 217 of 2015 for the offences instituted under Sections 304B and 201/34 of the IPC and Section 3/4 of the Dowry Prohibition Act.
As per the prosecution case, it is a case of murder of informant's married sister by the accused persons due to nonfulfilment of demand of dowry. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioner no.1 is the

No.58010 of 2015 (2) dt.09-03-2016 mother-in-law of the deceased, petitioner nos.2 and 3 are the brother-in-law of the deceased, petitioner nos.4 and 5 are sister-inlaw of the deceased, petitioner no.6 is the neighbour of the deceased and petitioner no.7 is the cousin-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The FIR was instituted after three days of the alleged occurrence. Prior to the institution of the present case, a UD case was instituted. It is a case of accidental fire which led to the death of the deceased.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Araria P.S. Case No. 217 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
