The petitioner apprehends his arrest in Ahiyapur P.S. Case No.592 of 2020, registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The petitioner is said to have killed the brother of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. There is no eye witness of the occurrence. Merely on suspicion, the petitioner is made accused in the case. It is further submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.183 of 2021(4) dt.15-12-2021 2/2 anticipatory bail of the petitioner and submits that the petitioner is also involved in the alleged occurrence. There is ample evidence in the case diary to show the involvement of the petitioner in the alleged occurrence.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Anjani Kumar Sharan, J.) Sanjay/- U T
