Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 447, 504/34 of the Indian Penal Code, 27 of the Arms Act and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that the accused persons abused by calling caste name, assaulted the informant, pelting stones and resorted to fire and no fire-arm injury was caused. It is submitted by the learned counsel for the petitioner that in the background of land dispute accusation has been levelled. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. On
Patna High Court Cr.Misc. No.54845 of 2015 (2) dt.04-12-2015 conclusion of investigation, the petitioners are not sent up for trial and differing with the Final Form, cognizance has been taken.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Goh P.S. Case No. 84 of 2014, pending in the court of learned Sri Gaurav Anand, Judicial Magistrate, Ist Class, Daudnagar, Aurangabad. With this observation this application is disposed of.
