The petitioner seeks anticipatory bail in Mashrakh P.S. Case No.52 of 2017 instituted for the offences under Sections 272, 273, 290 of the Indian Penal Code and Sections 30(a), 38, 41 of the New Amended Excise Act, 2016.

As per information the police has raided the place of occurrence and recovered the illegal liquor. Co-accused Anil Singh has disclosed the name of the petitioner. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of three weeks, the

Patna High Court Cr.Misc. No.24726 of 2017 (2) dt.11-07-2017 court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
