The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is of resorting to fire on the police party when the raid was being laid.
Since the case was registered in 2002 and the anticipatory bail application has been preferred in 2018, this Court is not inclined to grant anticipatory bail to the petitioner in connection with Kumarkhand P.S. Case No. 112 of 2002, pending in the Court of learned Chief Judicial Magistrate, Madhepura.
Patna High Court Cr.Misc. No.51811 of 2018(8) dt.19-02-2019 2/2 Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
However, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period six weeks from today without being prejudiced by the order of this Court.
