JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-09-2022 The limited prayer of the petitioner in this Civil Miscellaneous application is that the petitioner has filed a Suit for eviction on the ground of personal necessity and default in payment of rent and the learned trial court may be directed to dispose of the suit expeditiously. The Suit was filed by the petitioner in the year 2015 bearing Eviction Suit No. 106 of 2015.
Learned counsel for the petitioner submits that Suit has been filed in the year 2015. Learned counsel next submits that the last plaintiff's witness has been examined in the Suit. Accordingly, submission is that a direction be issued to the trial court to dispose of the Suit as early as
Patna High Court C.Misc. No.551 of 2022(2) dt.20-09-2022 2/2 possible.
Having regard to the submissions made by learned counsel for the petitioner and taking into consideration the fact that the Suit is for eviction and the same is pending for the last seven years in that view of the matter the learned trial court i.e. Sub judge XIV, Patna is directed to dispose of the Suit as early as possible in accordance with law within a reasonable time frame.
This Civil Miscellaneous application stands disposed of.
