No one appears on behalf of the opposite party no. 2 though the Vakalatnama has been filed on his behalf by Shri Rajiv Ranjan Singh.
Learned counsel for the petitioner is permitted to make necessary correction in the prayer portion of the present transfer application.
The present application has been filed for transfer of Matrimonial Case No. 178 of 2015 from the Court of Principal Judge, Famiy Court, Bhagalpur to the Principal Judge, Family Court, Munger.
Patna High Court MJC No.1577 of 2015 (3) dt.07-03-2018 It is submitted that the petitioner was married to the opposite party but on account of torture being meted out to her, she was compelled to leave her matrimonial home and go back to her parental house and is now residing at Munger. It is further submitted that since she is living at her parents' house in the district of Munger, she is unable to go to Bhagalpur from Munger on each and every date. She is also apprehensive of her life and safety. It is further submitted that her parents are suffering from illness and are unable to accompany her to Bhagalpur for contesting the matter. It is, thus, prayed that the aforementioned case may be transferred from the District of Bhagalpur to Munger.
Having heard learned counsel for the petitioner and on noticing the difficulty and inconvenience faced by her in contesting the case at Bhagalpur, it is directed that Matrimonial Case No. 178 of 2015 pending in the court of Principal Judge, Family Court, Bhagalpur be transferred to the Court of Principal Judge, Family Court, Munger The application stands allowed.
