The petitioner apprehends his arrest in connection with Bikram P.S. Case No.110 of 2019/G.R. No.1201 of 2019 registered under Sections 379, 420, 467 and 468 of the Indian Penal Code besides Sections 26(a), 27, 21(a), 22, 4 and 40 of the Bihar Minor Mineral Concession (BMMC) Rule, 1972. The accusation is of running the brick kiln illegally by the petitioner causing loss of Rs.1,09,710/- to the State Exchequer.
Learned counsel for the petitioner submits that after institution of the present case and rejection of prayer of the petitioner for grant of privilege of pre-arrest bail by the court of
Patna High Court CR. MISC. No.44150 of 2019(2) dt.18-07-2019 2/2 the Additional Sessions Judge-VI, Danapur, Patna, through the impugned order, the petitioner has deposited Rs.1,09,710/- in favour of Assistant Director Mines, Patna, and Rs.2100/- under the head of sales-tax in favour of the District Mineral Foundation, Patna, which would appear from Annexure-2 series to this application.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Danapur, in connection with Bikram P.S. Case No.110 of 2019/G.R. No.1201 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
