This is a petition for grant of anticipatory bail for offence under Section 414/34 of the Indian Penal Code. Name of the petitioner has transpired in the confessional statement of the co-accused, Md. Shamsher Ansari. Submission of the learned counsel for the petitioner is that the recovery of stolen property is from Md. Shamsher Ansari. There is no other material against the petitioner. Petitioner has been falsely implication and the confession before the police is no evidence.

Finding substance in the submission, aforesaid, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Farbisganj P.S. Case No. 12 of 2017 to the satisfaction of the Chief Judicial Magistrate, Araria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
