2. The petitioners seek anticipatory bail in connection with Sarairanjan P.S. Case No. 251 of 2025, registered under Sections 126(2), 115(2), 303(2), 352, 351(2), 351(3), 324(4),

Patna High Court CR. MISC. No.44779 of 2026(2) dt.15-07-2026 2/3 324(5), and 3(5) of the B.N.S., 2023.

3. The case of prosecution, in short is that the accused persons stopped the informant (Smt. Nirmala), beat her, and snatched her gold ornaments and mobile phone. When her sister-in-law, Manju Devi, tried to save her, she was beaten with a stick. Later that day, the accused also damaged the informant's crops and threatened her family.

Learned counsel for the petitioners further submits that perusal of the F.I.R. reveals that the only allegation of physical assault is against Petitioner No. 1, which is on non-vital part of the body. No specific overt act of assault has been attributed to the other petitioners, and the allegations against them are general, omnibus, and cosmetic in nature. Furthermore, although petitioner nos. 1, 2, and 3 carry a criminal antecedent of one case, namely, Sarairanjan P.S. Case No. 148 of 2025, they are already on bail in that case. The said case was also registered by the same informant party arising out of the same land dispute. It is submitted that the informant party is in the habit of lodging false and fabricated cases to harass the petitioners. Learned counsel submits at the bar that the alleged injury is simple in nature.

5. The learned A.P.P. opposes the bail prayer.

6. Considering the family land dispute, the pending title suit, the simple nature of the injury on a non-vital part of the body, and the lack of any specific assault allegations against the other petitioners, this Court is inclined to grant anticipatory bail.

7. Accordingly, in the event of arrest or surrender within four weeks from today, the petitioners above-named shall be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Samastipur/concerned court, subject to the conditions laid down under Section 482(2) of the BNSS.
