ANJANA MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Minapur P.S. Case No. 62 of 2015, registered for offences punishable under Sections 272, 273, 420, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that in fact, there has been no recovery from the conscious possession of these petitioners. It is submitted that a Van was intercepted and 400 litres of spirit was recovered from the said Van. The name of the present petitioners have been surfaced only on the basis of Statements made by the Driver and the Khalasi of the aforementioned vehicle that they are being hired by these

Considering the nature of allegation made and also that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 62 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
