Petitioner apprehends arrest in connection with Gopalganj Mahila P.S. Case No. 16 of 2017 registered for the offence punishable under sections 493, 376, 341, 323/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has no concern with the informant. Informant is a lady of doubtful character. Injury report does not supports the allegations. Petitioner has no criminal antecedent. Allegations levelled in the first information report does not constitute any offence either under section 376 or 493 of the Indian Penal Code.

Learned counsels appearing for the State and the informant

Patna High Court Cr.Misc. No.32645 of 2017(6) dt.10-10-2017 2/2 opposes the prayer for bail and submit that there are specific allegations against this petitioner. Informant in her statement under section 164 Cr.P.C. has supported the allegations. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
