Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioners apprehend their arrest in connection with Ben P.S. Case No. 50 of 2021 registered for offences under Sections 341, 323, 325, 308, 379, 504, 506/34 of the Indian Penal Code.

It has been submitted that the parties have entered into a compromise.

Patna High Court CR. MISC. No.55306 of 2021(2) dt.24-05-2022 2/2 Considering the fact that the parties have entered into a compromise and if the petitioners are sent to jail then it will enhance the enmity between the parties, this anticipatory bail application is allowed.

Accordingly, let petitioners, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nalanda at Biharsharif, in connection with Ben P.S. Case No. 50 of 2021 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

However, before accepting the bail bonds of the petitioners, the Court below shall verify the veracity of the compromise. If the informant supports the compromise then, the bail bonds of the petitioners shall be accepted by the Court below. If the informant denies the compromise, in such a situation, the Court below shall not accept the bail bonds of the petitioners and they shall be taken into custody. (Sandeep Kumar, J) pawan/- U T
