The petitioner apprehends his arrest in Piar P. S. Case No. 13 of 2017 registered for the offences under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a retired military personnel aged about more than 70 years. It is further submitted that the seizure list was prepared on 21.09.2016, however the F.I.R. was lodged on 16.02.2017. He further submits that he is being made victim of some dispute between Pool Kumari Devi who is the maid servant of Chandan Kumar. Brother of Chandan Kumar is the staff in the office of Sub-Divisional Lok Shikayat Niwaran Office, East Muzaffarpur
Patna High Court Cr.Misc. No.24395 of 2017 (2) dt.01-06-2017 2/2 and he is behind the lodging of the instant case. Considering the facts aforesaid and the fact that the petitioner is a retired military personnel and he has got no criminal antecedent, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-V-cum-A.C.J.M., Muzaffarpur in Piar P. S. Case No. 13 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
