The petitioner seeks bail in connection with Bhagwan Bazar P.S. Case No. 158 of 2022 instituted for the offences under Sections 395 of the Indian Penal Code. The petitioner is not named in the F.I.R, which has been lodged for burglary in the shop of the informant from where Rs. One Crore and Fifteen Lakhs was looted. The petitioner's implication in the case is only on the basis of confession of an accused person, namely, Shubham Kumar, who has disclosed that the petitioner provided vital information to the miscreants for committing

Patna High Court CR. MISC. No.46081 of 2022(2) dt.25-11-2022 2/2 theft / burglary in the shop of the informant. From the house of the informant, only a mobile telephone and a motorcycle were recovered, which according to the petitioner belongs to him.

The petitioner otherwise has no criminal antecedent except for his implication in a case involving breach of Excise Act.

He is in custody since 25.05.2022.

Regard being had to the afore-noted facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Saran at Chapra, in connection with Bhagwan Bazar P.S. Case No. 158 of 2022 .
