JUSTICE BIRENDRA KUMAR ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in connection with Bhaptiyahi P.S. Case No.5 of 2018, registered for the offences punishable under Sections 406/409/420/34 of the Indian Penal Code.
Petitioner was Panchayat Secretary at the relevant time and allegation is that in collusion with the local Mukhiya he defalcated public money of different government schemes fully detailed in the FIR. The allegation has been supported by material collected during investigation.
Considering the nature of allegation and financial embezzlement, I am not inclined to grant anticipatory bail to the
Patna High Court Cr.Misc. No.50874 of 2018 (4) dt.26-09-2018 P2/ petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within three weeks, the prayer for regular bail shall be disposed of without being prejudiced by the order of this Court.
