Petitioner seeks bail in a case registered for the offences punishable under Section 354(b) of the Indian Penal Code and Section 8 POCSO Act. After investigation, police submitted chargesheet under Section 354(b) I.P.C and 12 of POCSO Act.

Allegation against the petitioner is that he attempted to sexually assault the informant, a minor girl, when she had gone out to attend call of nature.

Submission is that the petitioner is in custody since 09.03.2019. Investigation of the case is already complete. Petitioner has got no criminal antecedent and the matter appears to be of some affairs between the two since before.

No.42539 of 2019(2) dt.11-07-2019 2/2 Considering the nature of allegation and period already undergone as well as completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bikram Police Station Case No.73 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
