====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 20-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mansi P.S. Case No.127 of 2016 registered under Sections 302 and 120(B)/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, in paragraph-75 of the case diary, the spy has disclosed that there is hulla in the entire village that this petitioner alongwith Vikram Yadav, Vigul Yadav and others had their hands in committing the murder of the deceased Rajdeep Yadav. Later on, in paragraph-106 of the case diary, it has come that prior to the

Patna High Court Cr.Misc. No.2422 of 2017 (4) dt.20-06-2017 2/2 occurrence, this petitioner had talked with the co-accused Vikram Yadav. Except that, there is nothing against the petitioner to show his involvement in the commission of the alleged offence. Further submission is that while the petitioner is accused in one another case, as detailed in paragraph-3 to this application, but in that case, the petitioner is on bail.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No.127 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
