JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This application, for grant of anticipatory bail, arises out of Barharia P.S. Case No. 149 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 307 and 302 of the Indina Penal Code.

Allegation against the petitioner and others is of assaulting the husband of informant and her son, causing death of husband of informant and severely causing injury to her son. Submission of learned counsel for the petitioner is that there is no allegation against the petitioner of assaulting the deceased rather allegation of assaulting the deceased is against other accused persons Learned counsel for the State and learned counsel for the informant opposed the prayer for anticipatory bail and

No.43726 of 2019(5) dt.18-10-2019 2/2 submitted that in the occurrence husband of the informant died and son of the informant has sustained two grievous injury, for which, he was referred to Gorakhpur hospital. Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
