The learned counsel for the petitioner has submitted that on account of certain personal difficulty, the counsel for the petitioner could not comply with the aforesaid peremptory order dated 6.2.2023, hence, a sympathetic view be taken and the aforesaid petition be restored to its original file. 3.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and proper to restore the aforesaid

Patna High Court CR. MISC. No.48663 of 2023(2) dt.02-08-2023 2/2 petition bearing Criminal Miscellaneous No. 6727 of 2023 to its original file, subject to the registry verifying the fact as to whether the defects, as pointed out by the registry, have been removed or not.
