The petitioner seeks anticipatory bail in Khagaria P.S. Case Noi.305 of 2014 instituted for the offences under Section 135 of the Indian Electricity Act.

On raid it was found that petitioner was using electric power by committing theft causing loss of Rs.9990/-. Learned counsel for the petitioner submits that on the day of raid petitioner was allotted electric connection. In such view of the matter, petitioner is directed to deposit Rs.4500/- before the court below which will be subject to the result of the present case and if it is found that petitioner would succeed in the case the said money will be

Patna High Court Cr.Misc. No.28235 of 2017 (3) dt.13-07-2017 adjusted from his future bill.

If the petitioner surrenders and deposits Rs.4500/- within four weeks before the court below, the court below is directed to release him on anticipatory bail. With the aforesaid observation and direction this application is disposed of.
