====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 13-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. This Cr. Misc. petition has been filed to cancel the bail of the O.P. No. 2 which was granted by the Co-ordinate Bench of this Court vide order dated 21.03.2017 in Cr. Misc. No. 13938 of 2015.
3. Learned counsel for the petitioner submits that dispute between the parties had been resolved on the condition that O.P. No. 2 will pay Rs. 2 lacs to the complainant/petitioner and also return all the articles given at the time of marriage in the existing condition. Counsel for the O.P. No. 2 had submitted that O.P. No. 2 will make payment of Rs. 2,50,000/- within a
Patna High Court CR. MISC. No.56021 of 2018(15) dt.13-11-2025 2/2 period of three months and the complainant/petitioner had not opposed the prayer for anticipatory bail of the O.P. No. 2. Learned counsel for the petitioner submits that although Rs. 2,50,000/- was paid by O.P. No. 2 after much delay but he has not returned the articles given at the time of marriage. Further she submits that this case may be disposed of with the liberty to the petitioner to file appropriate petition before the learned Court concerned, so that petitioner may be able to receive the remaining articles.
4. Learned A.P.P. for the State has no objection to this prayer of the petitioner.
5. In view of the submission of the learned counsel for the petitioner, this Cr. Misc. petition is disposed of with the liberty as prayed for.
