JUSTICE RAMESH KUMAR DATTA ORAL ORDER 24-10-2016 Mr. Ram Prawesh Kumar, learned counsel for the petitioner, seeks permission to withdraw the writ application in the light of the statement made in the I.A.No.8425 of 2016 filed by the petitioner that he has preferred Title Suit No. 121 of 2016 in the court of the Munsif-II, Gaya with respect to the same matter. The writ application is, accordingly, dismissed as withdrawn in the light of the aforesaid statement. Needless to say that the interim order passed earlier shall stand vacated and any statement made in the interim order should not be taken into consideration by the court below while deciding the title suit.
