JUSTICE SHAILENDRA SINGH ORAL ORDER (Per: HONOURABLE MR. JUSTICE RAJAN GUPTA) 29-06-2022 The instant case was dismissed for want of prosecution due to non-compliance of the order dated 02.05.2018.

Learned counsel for the petitioner submits that due to inadvertence mistake, defects could not be removed within the time granted by the Hon'ble Bench. As such, L.P.A. was dismissed on 9th May, 2018 for non-compliance of order dated 2nd May, 2018. According to him, if restoration application is allowed, the petitioner shall take immediate steps to comply with the order dated 2nd May, 2018.

Learned counsel appearing for the respondents does not have any serious objection to restoration of the matter. Under the circumstances, the application stands

Patna High Court MJC No.2529 of 2018(3) dt.29-06-2022 3/3 allowed and the case is restored to its original position and number.

Be listed as per roaster.

The petitioner undertakes to remove the defects within one week from today.
