JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code. The accusation is of killing the daughter of the informant after four years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the victim died due to illness on 01.07.2015 when the informant admittedly came to know about the occurrence on 04.07.2015 but the FIR was registered on 05.07.2015. The informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. Considering the nature of accusation, this Court is not

Patna High Court Cr.Misc. No.56949 of 2015 (2) dt.17-12-2015 2/2 inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Muffasil P.S. Case No. 234 of 2015 pending in the court of learned CJM, Gaya.

Accordingly, the application is disposed of.
