JUSTICE SANJAY PRIYA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Aurangabad (Town) P.S. Case No. 117 of 2017 instituted for the offence under Sections 341, 323, 325, 307, 379/34 of the Indian Penal Code. It has been submitted that the instant case has been filed just as a counter blast of the case filed by the petitioner on the same day vide Aurangabad (Town) P.S. Case No. 116 of 2017 for the offence under Section 307 of the Indian Penal Code and other allied Sections in which the family members of the petitioner was badly assaulted by the family of the informant. In the instant case there is allegation that petitioner along with two other named accused persons assaulted the

The injury report of the informant Dhiraj Kumar is enclosed as Annexure-3 wherein the Doctor has found two injuries. Injury No. 1 is simple in nature and with regard to injury No. 2, the opinion was kept reserved. The injury has been sustained by petitioner's side also Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Aurangabad (Town) P.S. Case No. 117 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
