The petitioner seeks bail in Madhepura P.S. Case No. 828 of 2018, instituted for the offence under Section(s) 379 and 411 of the Indian Penal Code.

Counsel for the petitioner submits that there is no recovery from possession of the petitioner. He is not named in the written report. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Prabhakar Kumar.

Petitioner is in custody since 16.1.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing
