JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Kuchaikote P.S. Case No.325 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 01.08.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and allegation is of recovery of 296.745 litres of liquor from the seized vehicle, as detailed in the FIR and the driver, Manoj Kumar, was apprehended who disclosed that the vehicle belongs to this petitioner.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.57048 of 2021(2) dt.07-01-2022 2/2 petitioner is the owner of the vehicle and as such was not knowing what was being carried by the driver. Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 01.08.2021, he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II,-cum-Special Judge, Excise, Gopalganj, in connection with Kuchaikote P.S. Case No.325 of 2020.

The application stands allowed.
