The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 448, 384, 504 and 379/34 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioners entered into the shop of the informant, started abusing and made assault to the informant. The accused persons also demanded extortion of Rs.50,000/-. On protest being made, petitioner no.1 Santosh Kumar, snatched gold chain from the neck of the informant, petitioner no.2, Ravi Kumar, took away two laptops from the counter and petitioner no.4, Prabhakar Kumar, took away cash of Rs.7,000/- from the
Patna High Court Cr.Misc. No.57954 of 2015 (2) dt.04-01-2016 2/2 counter of the shop of the informant. It is further alleged that petitioner no.3, Sonu Kumar, resorted to fire but did not cause any injury.
It is submitted by learned counsel for the petitioners that in the background of dispute with regard to returning of the loan amount, the accusation has been levelled. There is counter version of the occurrence also. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, preferably on the same day, if the petitioners surrender within a period of six weeks in connection with Bettiah Town P.S. Case No.147/2014, pending before the learned CJM, Bettiah, West Champaran.
With the above observation, this application is, accordingly, disposed off.
