The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act, Sections 20, 22 of the N.D.P.S. Act and Sections 25(1-b)c, 26, 35 of the Arms Act. 17 bottles of English wine each containing 375 ml. (6.375 liters), 40 grams of Ganja and one country-made pistol alongwith two cartridges were recovered from the Garage of co-accused Ramashankar Singh.

Name of the petitioner transpired during course of investigation. Nothing has been recovered from the conscious possession of the petitioner.

No.46437 of 2022(2) dt.21-10-2022 2/2 However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that besides recovery of illicit liquor, Ganja and country-made pistol with cartridge have also been recovered from the possession of this petitioner and petitioner has got two criminal antecedent also.

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
