ANJANA MISHRA ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the learned counsel for the informant as also the learned counsel appearing on behalf of the State.
The petitioner, being the younger brother of the husband of the deceased, is apprehending his arrest in connection with Phulwarisharif P.S. Case No.611 of 2016 for allegedly having committed the offence under Section 304B of the Indian Penal Code.
The allegation is of dowry demand against all the accused persons. There is no specific allegation against the present petitioner.
Considering the fact that the husband of the deceased
Patna High Court Cr.Misc. No.27818 of 2017 (2) dt.01-07-2017 2/2 is already in custody, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Mrs. Shema Eram, learned Judicial Magistrate 1st Class, Patna, in connection with Phulwarisharif P.S. Case No.611 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
