The petitioner seeks anticipatory bail in Barauni P.S. Case No.427 of 2016 instituted for the offences under Sections 414 of the Indian Penal Code The police on information has intercepted two motor cycles on which two persons were sitting. One motorcyclist was arrested and he has disclosed the name of the petitioner. The person who was apprehended did not produce the valid paper with respect to the motorcycle and told that he has purchased the motorcycle from one Sumit.

In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the

Patna High Court Cr.Misc. No.28770 of 2017 (2) dt.13-07-2017 prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of three weeks, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
