The accusation against this petitioner is that he along with one unknown person sat on the chest of deceased. The post mortem report of the deceased reveals that cause of death was asphyxia due to strangulation and admittedly, allegation of strangulation is against other co-accused person.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Bikramganj District Rohtas at Sasaram in Karakat P.S. Case no. 273/2013.
