Heard learned counsel for the petitioner and the respondents.

The petitioner has put to challenge an order passed by the Sub Divisional Officer, Ara dated 16.06.2020 whereby his public distribution licence granted under Bihar Targeted Public

Patna High Court CWJC No.2330 of 2021(5) dt.22-04-2022 2/2 Distribution System (Control) Order, 2016 (for brevity, Control Order, 2016) has been cancelled by the Sub-Divisional Officer, Sadar Ara, Bhojpur -cum- Licensing Authority. Indisputably, the petitioner has remedy of appeal under the Control Order, 2016.

In such view of the matter, this application is disposed of with liberty to the petitioner to prefer an appeal against the impugned order.

If such appeal is preferred within four weeks from today before the appellate authority with an application seeking condonation of delay, the appellate authority shall consider the same on its own merit and dispose of the same within the time stipulated under the Control Order, 2016 for disposal of an appeal.
