2. Petitioners are in custody in a case registered for an offence punishable Under Sections 191 (2), 118(1), 109, 74, 351

(2) of the B.N.S.

3. As per the allegations made in the FIR, the petitioners have abused and assaulted the informant and her family members due to which informant's husband sustained knife causing injury upon his mouth and her father-in-law got nose, lip and mouth injury due to which he became unconscious

Patna High Court CR. MISC. No.44470 of 2025(2) dt.16-07-2025 2/3 and fell down. It is further alleged that accused persons have also assaulted the informant with lathi causing injury on her waist.

4. Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in this case. He further submits that both the parties are neighbour and known to each other. He further submits that after the alleged occurrence took place, the informant's husband and her father-in-law were admitted to the hospital and the doctor has kept the nature of injury as reserve. He further submits that after lodging of this case both the parties have come to the conclusion to amicably settle the dispute arose between them through compromise petition which has been signed by both the parties and the said compromise petition is already placed on record as Annexure-P/3. He further submits that petitioners have got clean antecedent.

5. Learned APP for the State opposes the prayer for bail of the petitioners.

6. On perusal of the First Information Report, impugned order dated 12.06.2025, it appears that "a joint compromise petition has also been filed by the parties which shows that the petitioners have compromised the case with the

Patna High Court CR. MISC. No.44470 of 2025(2) dt.16-07-2025 3/3 informant and the injured. The informant and the injured are also present and supports the averments made in the compromise petition. The compromise petition is duly signed by the parties and identified by their respective counsels." So, considering the aforesaid facts and circumstances of the case, submission of the learned counsel for the petitioners and also the fact that both the parties have amicably settled the dispute arose between them and compromised the case and a certified copy of the compromise is already on record which has been produced by learned counsel for the petitioners, let the above named petitioners be released on bail, on their furnishing bail bonds of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No.347 of 2024.
