The petitioners seek bail in a case registered under Sections 341, 323, 504, 384, 307, 120(B), 353 & 34 of the Indian Penal Code.

The prosecution case in short is that on the information of quarrel between the parties, the informant with police personnel went to the place of occurrence and requested both the parties for peaceful solution. On this, the accused persons having Lathi, Danda in their hands, attacked the police party.

No.48337 of 2019(2) dt.02-08-2019 2/2 It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 20-03-2019. Charge sheet has already been submitted. General and omnibus allegation has been made against the petitioners. Free fight is alleged to have taken place between the parties. There is no specific allegation of assault against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, (West), Muzaffarpur in connection with Motipur P.S.
