The petitioner apprehends his arrest in connection with Benipatti P.S. Case no. 60 of 2014, registered under Sections 406, 420 and 120(B) of the Indian Penal Code.

The accusation is that one Sanjay Mandal talked to informant Laxman Dev Mandal on his mobile regarding fixing of mobile tower of Uninor company on his land and he assured that after establishment of the tower, the company will give job to his both sons and Rs. 5,80,000/- will also be given to him. Accordingly, informant became agree and on asking by Sanjay Mandal, he deposited Rs. 59000/- in the account of Dilip Mishra and again on demand, the informant deposited Rs. 45000/- in the account of Hem Kumar Jha and Rs. 12500 was also deposited in account of official of the company.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. nor his mobile was used for talking from the informant. In course of investigation, it has only come that this petitioner used to talk to named co-accused in this case. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Madhubani in connection with Benipatti P.S. Case No. 60 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
