2. The petitioners were duly appointed as teachers in Primary School, Sekhpura, Panchayat, Narayanpur, Block Tharthari, District Nalanda and U.M.S. Ballahpur, Panchayat Bhatwan, Block Hasanpur, District Samastipur respectively. On being aggrieved with the order of transfer, they have approached this Court seeking quashing of the same as contained in Memo No. PATN/Transfer/2025/01766 dated 20.06.2025 issued under the signature of District Education Officer, Patna, whereby the petitioner No. 01 has been transferred and posted from P.S. Sekhpura, Panchayat Narayanpur, Block Tharthari, District Nalanda to Panchayat Kondi, Block Pandarak, District Patna, whereas the petitioner No. 02 has been transferred and posted under Memo No. PATN/Transfer/2025/01731 dated 19.06.2025

Learned Advocate for the petitioners submitted that husbands of both the petitioners have been duly working in the office of the Advocate General, Bihar, Patna and agitating such ground, both the petitioners have submitted their application for transfer to the nearby place of their husbands however, despite their request, they have been posted at a far distant place, which is at the distance of 90km.

4. Learned Advocate for the petitioners specifically contended that transferring the petitioners at such distant place would serve no purpose and they have again been subjected to suffering, due to their long arduous traveling, despite being female teachers. For redressal of their grievance, they have made their respective representation before the Director Primary Education and further have also filed objection in the E-Shiksha Kosh Portal.

A counter affidavit on behalf of the respondent no. 3 has been filed, with a categorical assertion that in terms of resolution dated 07.10.2024 and department letter no. 45 dated 25.06.2025, the District Education Officer, Patna vide Memo No. 2913 dated 12.07.2025, constituted a three men Committee for consideration of complaint of the teachers and since the petitioners have already submitted their complaint before the

Patna High Court CWJC No.10718 of 2025(3) dt.02-09-2025 3/3 authority through E-Shiksha Kosh portal, the committee shall consider their grievances and redress the same, in accordance with law.

6. At this juncture, the learned Advocate for the petitioners interjected and submitted that after filing of the writ petition, the petitioners have already filed their respective objections on E-Shiksha Kosh portal by that the same is pending consideration till date.

Having considered the submissions set forth by learned Advocate for the respective parties and taking note of the fact that the petitioners have already filed their respective objections, which are pending consideration before the three men Committee, this Court directs the District Education Officer and the committee constituted pursuant to his direction to look into the matter and pass appropriate order keeping in view the policy of the government to transfer and posting of the wife and husband at the same place, within a period of four weeks from today.
