2. The petitioner has prayed for bail in connection with Runni Saidpur P.S. Case No. 02 of 2023 registered for the offence punishable under Section 395 of the Indian Penal Code.

3. The case of the prosecution is that certain miscreants entered in the branch of Utkarsh Small Finance Bank Ltd. and looted Rs. 12,34,454/-.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that initially the case was registered against unknown miscreants. During investigation,

Patna High Court CR. MISC. No.51440 of 2024(5) dt.27-03-2025 2/2 one Akhilesh Kumar has given his confessional statement and in his confessional statement he has named this petitioner. Nothing has been recovered from the possession of this petitioner. It has also been submitted that the co-accused Akhilesh Kumar on whose confessional the name of this petitioner has surfaced, has already been granted bail by the learned trial Court itself. Petitioner is languishing in judicial custody since 25.07.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Court of Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No.02 of 2023.
