The petitioner, who is in custody since 09.02.2022, seeks bail in connection with N.D.P.S. Case No. 33 of 2022, arising out of Kankarbagh P.S. Case No. 107 of 2022, dated 08.02.2022, instituted for the offences under Sections 21(a), 21(b) and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985. The allegation is that from the possession of

Patna High Court CR. MISC. No.46548 of 2022(2) dt.22-12-2022 2/3 the petitioner, nine paper packets in all was recovered, which weighed 7.6 gms. inclusive of the weight of the wrapper. The contents were found to be narcotics for which a general name was given in the F.I.R. as smack, but it was actually morphine.

It has been submitted that the recovery is of small quantity and the petitioner, a widow with an eight years old son to look after, is entitled for bail. Regard being had to the quantity of narcotics which is said to have been recovered from the possession of the petitioner, her gender and the period of custody as also taking into account that there is no other case pending against the petitioner, she/Rani Devi is directed to be released on bail on her furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IV, Patna in connection with N.D.P.S. Case No. 33 of 2022, arising out of Kankarbagh P.S. Case No. 107 of 2022.
