1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the anticipatory bail application with respect to petitioner nos. 1 and 2.
3. Permission is accorded.
4. Accordingly, the present anticipatory bail application is dismissed as withdrawn with respect to petitioner nos. 1 and 2 only.
5. The petitioner no. 3 apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 354, 307, 379, 504, 506 and 34 of the Indian Penal Code.
6. It is next submitted that from perusal of the
Patna High Court CR. MISC. No.51023 of 2024(3) dt.10-09-2024 2/2 allegation as alleged in the F.I.R., it would manifest that petitioner is alleged to have assaulted the informant by an iron rod causing injury on head, but then the injury suffered by the injured is simple in nature, which amply demonstrates that petitioner never had any intention of committing a serious occurrence.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no. 3 above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Amarpur P.S. Case No. 215 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
