JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-06-2017 Heard the learned counsel for the petitioners, the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Complaint Case No. 1123 (C) of 2014 for the offences punishable under section 498 (A) of the I.P.C and section 4 of the Dowry Prohibition Act. Perused the Mediator's report. The dispute between the parties has been resolved through the process of mediation. The terms of settlement mutually agreed upon by them is attached
Patna High Court Cr.Misc. No.8016 of 2017 (5) dt.29-06-2017 2/2 on the separate sheet, Both parties have decided to live separately having no concern with each other.
In the light of the settlement arrived at between the parties, the learned counsel for the petitioners seeks pre-arrest bail of the petitioners to which the learned counsel for the opposite party no.2 has got no objection.
In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. S.D.J.M. Buxar in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
