The petitioner seeks bail in connection with Laukhi P.S. Case No.83 of 2019 registered for the offence under Section 414 of the IPC and 27(b)II/28 of Drugs and Cosmetics Act, 1940.

The learned senior counsel for the petitioner submits that the petitioner is in custody since 03.05.2019, he is a person with clean antecedent and charge sheet has been submitted in this case.

The learned counsel for the petitioner submits that

No.55084 of 2021(2) dt.21-02-2022 2/3 from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that he received telephonic message that a person has been apprehended with drug accordingly he reached the place of occurrence and found the petitioner from whose possession a black bag was recovered and on search some medicines were found and the petitioner was not able to produce any documents relating to the medicines. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and from perusal of the seizure list it would manifest that medicines of various kind were recovered from the petitioner, the petitioner had all the requisite document but the informant was not willing to listen to him as the petitioner immediately was not in the position to produce the documents relating to the medicine.

The learned APP opposes the bail application. Considering the fact that the petitioner is in custody since 03.05.2019, he is a person with clean antecedent and charge sheet has been submitted in this case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds in the sum of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
