JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-07-2022 The present writ petition has been filed seeking the following reliefs:- "i) In the nature of Mandamus directing the State respondents to initiate action for providing the petitioner ingress and egress to the land which has been illegally encroached by the Respondents No. 8, 9 and 10.

ii) In the nature of mandamus further directing the Respondent no. 6, i.e. the S.D.M., Patna Sadar for disposing of the

Patna High Court CWJC No.2245 of 2021(2) dt.29-07-2022 2/2 Miscellaneous Case No. 1739 of 2018 pending before his Court. Iii) In the nature of mandamus commanding the respondents to provide immediate relief to the petitioner granting her ingress/ egress, access to her land by removing the encroachment made on public land bearing Tauzi No. 5130, Khata No. 366, survey plot no. 5567 by the private respondents No. 8 to 10 and for which the petitioner is entitled in the facts and circumstances of this case." At the outset, the learned counsel for the petitioner, as far as her prayer for removal of encroachment made over the public land in question is concerned, seeks liberty on behalf of the petitioner to approach the Circle Officer, Patna Sadar, Patna i.e. the Respondent No.7. Liberty so sought is granted.

As far as the prayer of the petitioner for directing the respondent no. 6 i.e. the Sub-Divisional Magistrate, Patna Sadar to dispose of the Miscellaneous Case No. 1739 of 2018 is concerned, the Respondent No. 6 is directed to pass final order in the said case within a period of 12 weeks of receipt/ production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
